In-person Classes

By booking into a class you automatically agree to the below Terms & Conditions.

DEFINITIONS

  • Class Pack means a 12-class pack for at the Participating Practice;
  • Clients means new and existing patients of Jointli;
  • Participating Practice means a Jointli practice which is participating in Group Classes.

SAFETY & HYGIENE

  • Patients must use the main entrance to the practice when entering or leaving the practice.
  • Fire exits, which are clearly marked, are there in the interests of safety and clients must not interfere with these exits for any reason.
  • In the event of a fire, Clients are asked to make their way to the nearest available exit.

BOOKINGS & ATTENDANCE

  • Class packs are valid for 6 months from the date of purchase.
  • Please be aware classes are on a first come first serve basis. To avoid disappointment, classes can be booked up to 12 weeks in advance.
  • If you have not booked into a class, in order to avoid disappointment, please call to check that the classes have availability and are taking place.
  • Practitioners reserve the right to restrict clients to a particular class type for safety reasons at their discretion. Practitioners reserve the right to turn clients away if they do not have the correct medical clearance.
  • We ask patients to attend at the time of their booked appointment time.

PAYMENT

  • To book into a class you must either have pre-purchased classes in your account or pay at the time of the appointment.
  • Class packs will expire 6 months from purchase. 
  • Payment must be made upon or prior to attendance, no exceptions.
  • Classes are not transferable to another individual and cannot under any circumstances be used by another person. If someone other than the person booked into the class arrives to use the class, they will be turned away from the class – or asked to purchase their own classes.

CANCELLATIONS

  • At Jointli our class sizes are small and can fill quickly. All clients must adhere to our Cancellation Policy:
  • We request cancellations be made more than 24 hours prior to your class beginning,
  • If you cancel within 12 hours of your class you will forfeit that fee. We understand that sometimes unforeseeable circumstances can arise, but we have to be strict, fair and consistent with all clients, therefore, no exceptions will be made.
  • Practitioners and classes are subject to change without notice. Jointli reserves the right to cancel classes if necessary.

CLIENT CODE OF CONDUCT

In the practice, you agree to:

  • Use all equipment with care and as instructed by the Practitioner;
  • Respect and follow directions of the Practitioner at all times;
  • Not disrupt the class or threaten the environment in any way; and
  • Be respectful and courteous to other people in the class including the practitioner.

Jointli has the right to remove you from the class and not allow you to return to the practice (in which case you will be refunded the remainder of any credits) if in their opinion you breach the above.

AGE LIMITS AND CHILD POLICY

You must be at least 16 years of age to attend our classes. Children under 16 are not permitted in our practice unless accompanied by an adult (who is not attending a class).

COMMUNICABLE DISEASE

If you have contracted a communicable disease, please ensure you have clearance in writing from your doctor before attending your next class. This is for the safety and well-being of all our clients, staff and customers.

ANIMAL POLICY

No animals are allowed inside the Practice at any time unless documentation is provided acknowledging they are a certified service animal. Jointli has the right to ask you to leave if you have brought an animal into the Practice.

Participant Waiver and Release 

You have enrolled in a personalised health and fitness program offered by Jointli St Leonards. You understand that this program may include physical activities such as muscle strength and endurance training, cardiovascular conditioning, and various other fitness exercises. You may also participate in group classes or use the gym facilities.

VOLUNTARY PARTICIPATION 

Your participation in any class or training session is entirely voluntary. You are under no obligation to perform or continue any exercise you're uncomfortable with, and you may stop at any time. If you experience light-headedness, dizziness, nausea, pain, or discomfort, you should stop immediately and notify your instructor.

ASSUMPTION OF RISK

You acknowledge that physical training involves inherent risks. These may include, but are not limited to:

  • Falls resulting in serious injury or death
  • Injuries caused by your own negligence or that of others
  • Equipment misuse or failure
  • Strains, sprains, muscle tears, broken bones, shin splints, heat exhaustion
  • Injuries to the back, knees, or feet
  • Psychological stress, trauma, or anxiety
  • Other unforeseen health issues, including death

You understand and accept full responsibility for these risks, whether known or unknown.

MEDICAL DISCLOSURE

You agree to inform Jointli St Leonards of any medical conditions, injuries, disabilities, or other factors that could impact your ability to participate safely. If you are pregnant or in the postnatal period, you confirm you are medically cleared for low- to moderate-intensity supervised exercise and have no contraindications to participation.

RELEASE OF LIABILITY

In consideration of participating in this program and using Jointli facilities, you hereby release Jointli St Leonards, its staff, instructors, agents, volunteers, and contractors from any and all claims, demands, or causes of action arising from your participation. You and your heirs agree not to hold Jointli responsible for any injury, loss, or death resulting from your involvement.

EMERGENCY MEDICAL CARE

You authorise Jointli staff to seek emergency medical assistance on your behalf if needed. You understand you are solely responsible for any costs incurred.

PERSONAL BELONGINGS

You acknowledge that Jointli St Leonards is not responsible for the safekeeping of your belongings. If you experience a theft or loss, you should report it immediately to a staff member, who will assist where possible.

ONGOING AGREEMENT

This waiver applies to all present and future participation in Jointli programs, classes (in-person or online), and facility use. If any part of this agreement is deemed invalid or unenforceable, the remaining sections shall remain in full force.

By participating, you confirm you have read, understood, and voluntarily agreed to the terms above.

Online Classes

YOUR OBLIGATIONS

  • Online classes are conducted at your own risk. It is your responsibility to create a safe and clear environment and only participate in Online classes if you are fit and able to do so.
  • You agree to comply with all directions and guidelines that are given to you through the Online Classes with respect to proper and safe participation.
  • If you experience any faintness, shortness of breath, pain or dizziness, you must immediately stop all physical activity and seek medical advice before participating in Online classes again.

INTELLECTUAL PROPERTY

  • All Online classes, content, photograph, videos and any other materials on the Website, our Instagram page or Facebook page remain the property of Jointli.
  • All copyright, trademarks, design rights, patents and other intellectual property rights (whether registered or unregistered) in the Jointli belong to us.
  • You must not reproduce, copy, share, sell, or deal with any of our Jointli materials without our express written permission.

LIMITATION OF LIABILITY

  • Jointli accepts no responsibility for any injuries or damage that may occur to yourself and/or equipment used at home.
  • You, your heirs, assigns or legal representatives fully release Jointli (and its associated entities, franchisees, patients, employees and contractors) from any claim, loss, damage or expense of any kind including in relation to personal injury, property damage/loss, or wrongful death, occurring during the home classes, whether caused by negligence or otherwise.
  • Any liability in connection with the home classes under any statutory right (including any condition or warranty implied by law or any guarantee or other right under any statute) that cannot be excluded is limited to the resupply of the home class or the payment of the reasonable cost of same.
  • You agree to indemnify and hold us harmless from all liabilities, claims, and expenses, including legal fees, that arise from your use or misuse of the Website, Jointli third party providers, Facebook page, Instagram page or your breach of these terms and conditions.

Policy review statement

This policy will be reviewed regularly to ensure it reflects the current processes and procedures of Jointli and current legislation requirements.

We may modify this policy at any time, at our sole discretion and all modifications will be effective immediately upon our posting of the modifications on this website. Please return periodically to review this policy. 

We will notify patients of any significant changes by posting updates on our website and at the practice. Continued use of our services constitutes acceptance of the updated policy.
